When did the EU AI Act's Article 4 AI literacy obligation start?

Article 4 AI-literacy obligations entered into application on 2 February 2025, alongside the Article 5 prohibited practices. Article 4 is a literacy and competence duty rather than a mandated training course: organisations must take measures to ensure staff using AI have sufficient AI literacy proportionate to their role. From August 2026, national authorities move into an active supervision and enforcement phase.

Were the EU AI Act obligations delayed to 2027?

Accepted Answer

Not all of them. The 2026 Digital Omnibus delayed many high-risk obligations: stand-alone high-risk systems under Annex III move to 2 December 2027, and high-risk AI embedded in regulated products under Annex I moves to 2 August 2028. The Article 4 AI-literacy duty was not deferred and has applied since February 2025. Article 50 transparency duties apply from 2 August 2026 in defined scenarios.

Does the EU AI Act apply to ordinary business use of Copilot or ChatGPT?

Accepted Answer

Ordinary internal productivity use generally does not trigger the high-risk obligations such as fundamental rights impact assessments, human oversight regimes or worker notification. Article 50 transparency duties are scenario-specific rather than a blanket duty: for a deployer they apply to emotion recognition, biometric categorisation, deepfakes, certain synthetic media, and AI-generated text published to inform the public on matters of public interest. However, the Article 4 AI-literacy duty applies broadly, and GDPR applies to any personal data staff put into public AI tools.

Is using AI in recruitment or HR high-risk under the EU AI Act?

Accepted Answer

Some employment and worker-management uses fall within the AI Act's high-risk classification under Annex III, specifically AI systems used for recruitment, candidate selection, promotion, termination, task allocation, or performance monitoring and evaluation. Under the Digital Omnibus timetable those obligations are expected to apply from 2 December 2027. Using AI to draft a job advert is not high-risk; using it to screen or rank candidates may be.

Is there a UK AI Act?

Accepted Answer

No. The United Kingdom has no AI Act. The UK regulates AI through existing law, principally UK GDPR and sector regulators such as the ICO. The EU AI Act can still reach UK organisations extraterritorially where an AI system is placed on the EU market, put into service in the EU, or where the output produced by the system is used in the Union.
